The car:

The driver of the car is at fault for the accident. Even an illegal u turn wouldn't cause an accident unless the person behind was following too close. A good lawyer will argue this and the truck driver will just lose his truck triver licence (or be told to do the course).

If I flew into anything in a vehicle and killed all the passengers, I get to go to jail for it. The driver is lucky they are dead and don't have to answer for what they did.
