So thing about outdated laws is they create loopholes that seem more nefarious than they actually are. When the law was written the requirement to publish in local newspapers made sense as internet wasn't mature yet. However as newspapers vanished and job searches moved online, this requirement became easy to fulfill to prove exhaustive efforts. Same case with the salary cap being low for current times...

Of course Indian companies have exploited it heavily. And it's more or less too late for changing the established paradigm which benefits everyone except American developers.
