This is no different than sending resumes to every job listing you can find and giving others tips to do the same.
The burden here would really be on the company to explain how what they're doing is not conspiracy to exploit the H1-B visa system.
I kind of hope this stuff does make it to the courts. The rulings on such cases and the media coverage would be quite the eye opener for many people.
I suspect they will try to avoid this option for as long as possible because any possible exposure of this visa gift at those levels will endanger it.
The last thing any party in the visa grift wants is to have some young upstart politician getting wind of the public's awareness and distaste for it and thus running on a platform of destroying it.
These things can only continue to exist for as long as the larger population remains ignorant.
