If someone were to try to break into your house and murder you, they would still get charged with attempted murder, along with breaking and entering. They could claim they were just breaking into your house, and NOT trying to murder someone, but the courts don't see a failed attempt as an innocence. In such a scenario, the court favors your fear for your life over whatever the motivation was of the person(s) involved.
Just because a coup isn't successful doesn't mean you get to go "lol we weren't actually doing a coup bro chill". If you're storming a building, and no one dies, you can't say "We weren't trying to kill anyone" because we don't know what your intentions were. The fact you're trespassing some where you're not supposed to be lets credence to the fact you're not there to have civil discourse, and the worst is going to be assumed. If you gave the same leeway to a minority breaking into your home as you would a Jan 6er, you'd be dead.
