The problem is that's difficult to prove. Intent is difficult to establish and a lot of those cases just get thrown out because recording in and of itself is protected by the First Amendment. Much of it is just based off assuming the worst in other people and fearmongering.

It's difficult to prove and difficult to enforce. Nowadays we have cameras so small you would never notice them and 360 degree cameras. Not to mention chances are in public you are being recording and monitored constantly anyway. People fly drones around and have a bird's eye view of an entire beach with incredible zoom capabilities. There's really nothing you can do without reasonably infringing on people's rights.

If intent is obvious, like going into a public restroom and recording over stalls then yes, intent is obviously malicious. But just being out in a park and recording what you see, there's nothing you can do about that because people's rights don't suddenly end where your feelings begin lmao
