You cited some random provincial ruling regarding canadas version of the WBC (reverend phelps). Even the WBC were not stupid enough to mail out flyers calling for the eradication of fags, they simply protested at funerals of dead American soldiers "thanking god for killing them" which isnt hate speech.
As for the specifics of what you quoted, the part about the "god of the old testament punished sodomites" is a technically true statement, but weaponizing those words is where the legal line is crossed. Even in America there have been first amendment lawsuits lost due to calling for violence against certain groups, citing religious freedom as grounds to attack others. The WBC have good lawyers advising them what they can and cannot say.
