He was cognizant enough even just a few months before his death to give Hitler an ultimatum. Reign in the SA once and for all or he would declare martial law and the Reichswehr would rule the country, thus shutting Hitler (a civilian) out of decision making. Or in essence, get rid of Rohm or they would get rid of him. Hitler acquiesced and the Night of the Long Knives (which would arguably be considered the de facto end of the rule of law in Germany) ensued.

True, they waited over a year after his death to enact the Nuremberg Laws (Hindenburg had previously opposed attempts to eject Jews from the German civil service).
