In general the question about the status of downed MS pilots is interesting, because they're not exactly aircraft and not exactly land vehicles. It's obvious that most MS pilots will continue fighting after being downed, as they have a big chance of being picked up by their own only minutes after being downed, and they sometimes even fight alongside ground forces and other special operations people, meaning that a downed pilot may join the fight as part of their mission. In space, a downed MS pilot is much closer to a downed aircraft pilot clinging to their parachute, but it's obvious that it's not the same thing, as there's always a chance of them continuing resistance until being picked up or the pilot using a jetpack to maneuver themselves. Hell, a downed MS pilot in space might even manage to cling on to a passing enemy MS and force their way into the cockpit or mothership some way.
In other words, the laws and honour of war could only realistically be applied to a downed MS pilot, if they are clinging to a parachute in Earth's atmosphere (or straight-up surrendering). The retreating Zeon pilots in Solomon would've been valid targets, as a retreating enemy is still considered a combatant, and they could have jumped into a MS if any were brought to them in that moment.
