Several State Supreme Courts (including Pennsylvania) have actually declared that the State Constitution mandated Democrat gerrymanders, and SCOTUS can't hear the cases because they're solely based on State law rather than Federal law. There was an attempt to challenge that in North Carolina, and SCOTUS ruled in favor of the Supreme Court's sovereign right as the supreme branch of government as claimed under their own court ruling.

However, the GOP can use Federal law to override State electoral maps and subject them to Presidential boundarymaking, and it can even declare that only some States are subject to the law. Lyndon Baines Johnson did it in the 60s, and we can do it now as a result.
