Legally unworkable and only addresses the symptom. The driver should face jail time but the real problem is his records are public and a trucking company hired him anyway. You need to go after the companies hiring these fuckers. The feds have the power to regulate interstate commerce under the Constitution and long haul trucking is squarely interstate commerce. Trucking companies need federal licenses in order to operate which are granted by the FMCSA. What you do is an audit the licensing and citizenship information since there is a real safety issue with drivers who cant speak english or pass a CDL test driving on the roads. First illegal with a license from CA, WA or any other state which allows illegals to get a CDL automatically revokes the operating license. Fine them $1M for the first illegal and tack on $2M more for every one found thereafter. $1M is the insurance policy limits of every commercial vehicle you see on the road. If more than 30% of the fleet is found to be operated by illegals the consequence permanent license suspension without appeal. Make it so these companies either bend the knee, go bankrupt or just simply cease to exist because their license is revoked or the insurance companies refuse to insure them. All of this is perfectly legal and well within the powers of the federal government.
