That was found to be illegal years ago. The reality though is that AKS (the AKB48 agency) for example were never really bothered as you can see in the documentary Show Must Go On and I think in To Be Continued. The problem is the fans are bothered, or can be sometimes selectively. The "punishments" are made up nonsense agreed with the person involved in the hope it will get them off the hook. Minegishi survived to have longest career of anyone in the first generation of AKB48 and Sashihara, arguably the GOAT (and possibly the most over-exposed person on Japanese TV today) was the next idol to scandal after her. So apparently it matters apart from when it doesn't.
