The subject of the photo is not nude, sexually posed, or engaged in any sexual conduct. The sexually explicit material (the semen) is entirely separate from and external to the subject. The law is intended to prevent the depiction of a person as sexually explicit, not the depiction of a non-sexual person near something sexually explicit.
