It's not a bug, it's a feature! If everything is jumbled and inconsistent, it allows GW to parachute new units into each collection as they dream them up! Long gone are the stifling days of only a couple of troop, fast, elite or heavy choices being available for each army, now anything goes, allowing you to spend, spend, spend as fast as can think of new stuff up for you to buy!

Of course, the whole publishing wing exists as a way to advertise the setting and models. A cool Imperial Guard story? Man, wouldn't it be sweet to make up a guard army just like in that cool story you just read? The "size" (Warp-presence) of your soul only determines your ability to use psychic powers. Think of it like a hole into the Warp that you can pull Warp-energy through to power your psychic abilities. The bigger the hole, the more energy can flow through it, but the downside is that daemons can more easily enter your body through it and possess you. Tau basically have a tiny pinprick into the Warp that would only allow a trickle of power through, far too little to ever use psychic abilities but also too small for daemons to notice and enter. The average human is also largely unnoticed by daemons most of the time, and they can usually only squeeze through the hole under specific circumstances (a ritual to bind a daemon to a person or a location where the Warp is already bleeding into realspace), while psykers have a window into the Warp a daemon can easily enter through unless the psyker is very careful.

Well according to lore on the wikis the Silent King Szarekh knew his soul was gone, and he was the only one to receive perfect engrammatic circuitry. Engrams which not only could simulate the full details of his original mind and store all his memories, but which could even expand upon it. So likely this is another GW downs syndrome event.

If we instead assume Szarekh, and possibly others of the highest stature, actually kept their souls, then lots of other things don't really make sense. But if we really want this to be true, I suppose we could. It would just mean some lucky few Necrons have no reason to reverse biotransference. Unless somehow they can'r be creative or some shit because of a limitation on mind simulation by engrams.

I think it's more likely an author/editing goof. The Twice-Dead King series explicitly shows Necrontyr of royal blood getting tossed into the Biotransference forges and their souls are objectively gone.

Souls in this case was likely a poorly chosen way to represent the personality of a person without thinking of the metaphysical ramifications of this choice. "Essence" or "minds" would have been a better fit.
