well the server access is part of the devices basic functionality for both devices. You get security updates despite doing things on the hardware that apple prefers you're not allowed to. You keep access to software you bought and so on.

Companies can ban someone from online play I suppose, people can be disruptive and whatever, but what about single player games they paid money for? You just stole from the user if they lose ability to play them. You gotta give a refund.
Then the device obviously has to work as intended, if the server says "stop working" you stole 500€ from the user. How about dont do that? It cant be legal.
