The issue I think is that people are worried they'll do a Nintendo and sue anyone making anything similar or people are already avoiding doing something similar to avoid litigation and in doing so, stifling any kind of creativity, which isn't to say it's some groundbreaking amazing system, but that people can't expand on it for said reasons. Suits forbid anyone from experimenting because of it. Or at least, that's what I'd assume.

This is pretty much the issue. You can make something similar if you don't specifically copy what's in the patent. Doesn't mean they won't try to sue you for it and that just creates a barrier for people to not bother trying. For most people the hassle isn't even worth it. The only good thing is that you can't renew patents. The bad news is still that can patent game ideas in the first place. There's a lot of game patents and scratch your head as to why they got approved in the first place.

Isn't the patent just applies to the code itself? I'm pretty sure that anyone can make a game with competing and progressing npcs as long as it's original creation. M&B exists after all.

It reads a bit autistic because they always have to specify that it's a computer doing these things so they talk about a game character doing something "via a processor" and shit like that but the tl;dr is that they patented the whole nemesis system, including characters coming back, characters remembering how you killed them previously, characters changing their attributes when they reappear (e.g. being immune to backstabs if you killed him with a backstab)
So no, you can't just make your own system without getting raped in court

I'm fairly sure patenting a painting technique would also be legal. Patents aren't copyrights, you just publicize how exactly your new "invention" works and in turn get exclusive rights to make and sell it for I think 20 years?
