The third parties flopping thing is a bit sus imo. They didnt specify which third party didnt sell well.
Meaning it could be one of the big ones like Street Fighter or Cyberpunk.
Or it could be that Konami survival game that no one is talking about.
Switch 2 doesnt have that level of install base where any third party will just sell more atm compared to Switch 1.

I think you missed a few details there. Sony said that Nintendo WASN'T competing with them because Sony defined the PS5 market as being the "high performance gaming console market", which specifically excluded the Switch from the equation (because it would destroy all of their arguments against Microsoft). Sony said they couldn't compete with Microsoft if Microsoft held Call of Duty exclusivity, and the FTC judge told them that Nintendo has been doing fine without the franchise this whole time.
