What happened is that a few years before the White-Gold Concordat was signed, there were troops in Hammerfell. Most of these troops were likely local conscripts (i.e. Redguard warriors) because that's how the Legion operates. When the order came down to abandon Hammerfell so all of the legions could reinforce Cyrodiil, a SINGLE GENERAL allowed SOME of ONE of his legions to stay behind and desert.
This occurred two years before the concordat was signed. Hammerfell seceded from the Empire afterwards. And the Empire didn't help them after that because the Empire DID NOT WANT THEM TO SECEDE. Hammerfell was upset at the Empire for selling them out, hence why they seceded. If those "deserters" were still alive by this point in time, they would have most likely been Redguard soldiers, anyways (because most legions are local, and foreign troops would have no reason to desert to defend someplace that wasn't even their homeland). So, they would have been fighting for Hammerfell, anyways. It wasn't Imperials from Cyrodiil staying behind to protect Hammerfell, it was some of the Redguards that the Cyrods were stealing to defend their own lands.
