In that latter case it would be something like the devs releasing a listen server tool so people can connect with each other through one supported by the community, either P2P or to other servers hosted by community members. Gundam Evolution, a game that went EoS after a year, has had fans reverse engineering the code to produce their own online for the dead game, with lobby play available for more than a year at this point and casual matchmaking being worked on. SKG here would more or less require Bandai to give the tools community members have painstakingly reverse engineered, and then they wouldn't have to do anything else for the game ever again.

The issue is companies seeing they have to choose between eventually releasing intellectual property (AKA proprietary server tools and or code) OR just not doing online games in Europe.

Let's put it very easy.
Imagine there is a game that has both single player and multiplayer, like an old CoD game.
Now the publisher shuts down the servers, but also revokes all the keys in order to prevent you to play the single player campaign.

The pentition wants to prevent that (they have a faq too on their website too).

I doubt they'll get the full list of concessions, private servers are probably just never going to be commonplace for big mainstream games again, the corporations will never give up that much control while the game is alive and won't be willing to spend the money to support them after it stops being profitable, but I could see making singleplayer modes unplayable because an unrelated server gets shut down becoming illegal, and probably some kind of mandatory warning about always online shit that won't actually change anything like the cookie popups
