I feel like nobody has actually looked at these guidelines. This feels like Nintendo wanting to go back to the 90s.
Basically, Nintendo doesn't want games on the Switch that are overtly political, which is an attitude that they had back in the 90s, which is why all real-world politics were censored on the SNES and N64. This is some Haye's Code-style stuff (one of the things about the Haye's Code is that portraying Nazis as monsters was banned because it was denigrating a real-life political group, which is why holocaust films were considered taboo under the Code).
They don't want games that "instruct criminal activity" which reminds me of how in Japan they have to censor portrayals of lockpicking because lockpicking is illegal, therefore you can't show people how it works. Under these guidelines, Nintendo would likely block GTA Chinatown Wars for having a hot-wiring minigaming.
These guidelines were rolled out last month when the Switch 2 released, and I think people are distracted from that. Developers will have to make a choice between releasing on Switch in a censored, "no political statements, nothing controversial" form, or skipping the platform altogether. The only reason Nintendo loosened their guidelines was that the N64 lost the console war so badly. But now they're in a cushy position, so they feel empowered to try to push Nintendo as a game platforming into a more kid-friendly position. Nintendo are not super concerned with third party developers, and this reinforces that.
