The talent didn't get paid because in the payment scheme of the company, they're at the bottom of the pyramid and have the lowest priority as they're not employees. When money starts to be tight, only they will notice it. Staff have to be paid not to break certain labor laws, which includes the founders (and if the company implodes so do investors).

It's pretty funny how Gunrun got 100% of aggro for the situation, but where the missing money literally is right now is likely with is MowtenDoo. He quit the company recently, but as he is a founder who likely had a big stake in the company, he would have actually been getting paid the whole time and would have exited with a significant sum of money (or else he would still own a big part of the company). That's where the last of the money that wasn't already distributed went, with MowtenDoo.

It's very dumb, which makes me think it might have not been intentional. The payment structure comes out of legal obligations, higher on the pyramid and first to be paid just means someone who would get you into more legal trouble quicker and have stronger support/leverage to fuck you. Talent happen to be at the lowest level of obligation. Maybe they didn't even realize this when first drafting up the company. Not everyone plans for the absolute worst case scenario and what that would look like.

It must have not been very apparent in their contracts at least since I don't think they would have gotten very far with the reputation as the company that passes money trouble straight down to the talent, but then again, maybe that's what the NDAs are for.

Gunrun already personally had multiple times that amount of money. This is not a running away with the bag kind of situation, he's just a rich guy playing CEO and fucked it up royally.

At this point he's probably just looking for how to reduce his personal liability so that he doesn't have to pay out of his own pocket (which he easily could). Legally I don't even think he can be made to pay out of pocket, but he could have to to save face since the tech space is his only expertise and living known as an evil guy kind of sucks. MTND leaving in May kind of fucks that up since he would have taken a good amount money with him, unless he was dumb enough not to get bought out of the company and is currently still tied to the ship as an investor.

Anyway, if all else fails and, let's say, if it would prevent him from going to jail, Gunrun can pay literally everyone involved. He personally has enough money, but is likely looking for any way not to do that. This is how this would all be handled and swept under the rug if there was no charity involved, curse the IDF yet again (mouse's lawyers were smart to put the charity allegations front and center)
