I think she'll try her hardest to settle. She doesn't want her personal info out, and as far as I'm aware, a court case would expose that info.
I'm no lawyer, but I think she could, in theory, buy a lawyer for a trusted friend who donated through the subathon, as they would have standing to sue for charity fraud. It would keep her name out of it at least.
But even still, every talent at the company is at risk of getting doxxed during the discovery process, so settlement seems most likely.
