Good Guy Orochimaru suggested murdering kids to spare them from poverty. In the Mizuki filler arc, Mizuki has a prototype curse mark that works differently and is even less stable.
This would mean Orochimaru had the idea for cures marks before he got Juugo and used him to make the kind he uses in the present.
It's possible that Anko's curse mark, despite having the same design as the one Sasuke got, is actually an older version that works more like the Juugo-based one than the one Mizuki got, but presumably not as well, and it might not even be capable of having the second form since that's supposed to be directly related to Juugo.

So coming off of the previous chapter, I think Shikamaru wouldn't come across as a brainlet who just keeps getting lucky if the durability part of the power system wasn't so glass cannon-y, as in realistically Tayuya could've just headshotted him with a thrown kunai because basically everyone could die to a weapon to the head or the spine, rather than trying to get up close for his contrived plan to work - which could've maybe been justified if the power system was skewed in such a way that Tayuya would've had to do maximum damage up close or otherwise soften him up first (or to tl;dr it, bladed/pointed weapons are in technicality too powerful here)
