In the Mizuki filler arc, Mizuki has a prototype curse mark that works differently and is even less stable.
This would mean Orochimaru had the idea for cures marks before he got Juugo and used him to make the kind he uses in the present.
It's possible that Anko's curse mark, despite having the same design as the one Sasuke got, is actually an older version that works more like the Juugo-based one than the one Mizuki got, but presumably not as well, and it might not even be capable of having the second form since that's supposed to be directly related to Juugo.

The problem with Madara, beside being extremely contradictory, is that we already had the previous Madara, him adding himself to the long chain of manipulators only makes everything more convoluted and dumber (how the hell did he scheme to kill Rin while being on life-support?).
