It's not the place of a forum or even necessarily the site owner to say who is and isn't allowed to use a service, when it comes to morality/criminology. We have or should have legal system in place which deals with people independently from the use and operation of the site.
If you have enough evidence to refuse service to individuals for criminal activity, you have enough information for a warrant.
Not to say a site owner can't ban whomever, but that doesn't make for a good forum no matter how much reddit gold you get.
private sites are not a courtroom, and shouldn't be treated as such.
