This issue was adjudicated and settled previously in Trump's first term. See National Urban League et al. v. Gina Raimondo et al., Stipulation of Dismissal states as follows:
"The tabulation of total population by States based on 2020 Census data and described by 13 U.S.C. Β§ 141(b), and the P.L. 94-171 Redistricting Summary Data File based on 2020 Census data and described by 13 U.S.C. Β§ 141(c), will not include or otherwise incorporate any information on citizenship or immigration status, nor will such counts or data products be affected by any information on citizenship or immigration status."
The Census Bureau also acknowledged that the βillegal alienβ citizenship data it was preparing for Trump was statistically unfit for use in apportionment and redistricting. The US government also paid over $1.6M in attorney's fees to the plaintiffs, which were your tax dollars hard at work.
Article 1 Section 2 is as clear as can be: "Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons." Noncitizens were included even in slavery times; thus, "numbers" most closely means residents.
