The claim is that he never entered the capital building. He just stood outside. That's why the feds didn't go after him and that's proof he didn't inform to avoid charges.

The only problem with that is that is actually entirely irrelevant given the circumstances. He directed his followers to dismantle barricades and ignore the commands of the police or authorities otherwise. This is enough, arguably, for incitement charges. That's not to mention the fact he was almost certainly communicating online to organize. The main point that dismantles the argument, though, is that other leaders or prominent right wingers had federal charges filed against them when they weren't even present in Washington. A president of a proud boys chapter got like 20 years, all he did was respond to messages and telling his underlings to "do what's necessary" far less, and far more ambiguous than Nick directly instructing others to enter the capital building.
