Yeah that's fair. I think a decent lawyer could still beat the sex charges but it's still disorderly conduct and probably something else. If someone is throwing dildos in public I don't feel bad for them, but I also don't think it necessarily has to be an automatic sex-offender charge unless the act and intent were heinous and sexual in nature.

The main problem is you can argue it wasn't sexual in nature but you're gonna have to find a jury that doesn't agree with that when the reality is you hit a 12 year old with a sex toy. Even if you argue hitting her specifically was an accident it'll still be a bit of an uphill battle considering your motives of either "join in on a stupid trend" or "influence a crypto betting site" don't exactly make the jury sympathetic.

There is no direct connection between the killer and the guy with the beef. They don't need to know each other or trust each other. They can't scam each other. The betting market is not liable for facilitating murder (I think).

If it's a centralized site they would definitely try to crack down on it. However, the betting market could be entirely decentralized with cryptocurrency and smart contracts.

1. Publishing the bet on a blockchain.
2. Placing cryptocurrency in escrow administered by a smart contract.
3. Resolving the bet using an oracle or a second round of betting like this: after the deadline of the original bet is reached, people stake money on the outcome, which is now publicly known (Santa died or didn't die), after a short staking period, the minority side of stakers lose all their money to the majority side.

You don't even have to convince the jury. The defense lawyer just has to convince the prosecution to drop the charges before trial even starts. I've sat in on a murder trial before, and it taught me that there are lot of things that happen prior to the trial that are equally as important as the trial itself.

I just see the sex charges as something they're throwing at him to see what sticks, but ultimately will get dropped before trial. I see your point, but I'm just thinking that building a case for it would be more difficult than you think it is.

it's just a legal tactic. Prosecution comes-up with the highest amount of charges possible, defense negotiates it down in a plea-bargain so nobody wastes any time or money on a trial. Unless he has a truly horrible lawyer, I doubt that particular charge sticks.
