Kroc was retarded and he had an axe to grind with the brothers. The brothers weren't capitalists and were fine with a handful of restaurants in California.
Basically whatever Kroc tried to do with the company, the McDonald brothers BOTH had to sign an agreement with in writing, but both brothers were basically retired and never got back to Kroc. This made him big mad.
Richard McDonald got the last laugh and was actually recognized by the company after Kroc died, even though Kroc tried to gaslight everyone into thinking he founded McDonald's.

Hell, half of the stuff on the early McDonald's history on Wikipedia is sourced from Kroc's autobiography.
