Like, jurisprudence actually made porn involving drawn minors illegal in 2007, just that no one in the french comic world really took it seriously because it was only used to censor degenerate foreign animu. A couple child protection associations decided to take it seriously a couple years ago, though.
And Vives is an easy target since it's actually been a recurring theme in his work since even before he became a professional, with plenty of incriminating forum posts, and he's been a very, very high-profile author since like 2009.
His possible defenses have included:
-It's art! Freedom of speech! (you've gotta go to court to actually defend that, then up to the judge)
-It's only drawings! (same)
-I was only doing it *ironically*. Also the forum posts about wanting to fuck little girls. (same again!)
-A lot of great authors did in the 20th century! (jurisprudence changed, as well as general societal views about that sujbject matter)
-It's a ploy by far right organizations to test the limits of free speech under the current jurisprudence and bring back state censorship of art (Factually true! But also, not an actual defense!)
-You brought me before the wrong court (That one actually worked! But it's only a temporary delay)
It's still kinda hard to say how it'd go once in a proper trial (favoring guilty though), and the decision would solidify or reshape jurisprudence for decades to come.
