I thought of that list of comics that were supposedly in the public domain that one preportedly /m/fag raved about last night. I thought "Nah, no fucking way". I went to copyright.gov in their public records. After realizing Marvel switched from Canam to Atlas on their later titles I was able to look up the copyright numbers. Here's the results, it was real, only issues 42 through 48 are present. The first forty one issues of Journey Into Mystery really never renewed their copyright on time in the 80s. It wasn't just a string of Strange Tales.

Issue 17 has a reprint from a different comic line, not sure if Adventures Into Terror issue 13 has its copyright expired. Issue 18 had a reprint for Strange Tales 13. Most of what the first twenty issues involve:

-One offs dying (more than one named Bill)
-Vampires
-Zombies
-Ghosts
-Satan (not Mephisto or Satannish) or Death

Issue 29 has the same thing but for elephant ghosts.

Issues 37 and 38 both feature sea serpents. Mars comes up a lot. Issue 40 has a reprint from Marvel Takes 140. Last few issues has a thing for time travel.

Aaaaaaand that's all folks! Someone should inform horror and pulpy sci-fi fans about all this.

They likely know but they have a deal with Marvel to do reprints of stuff Marvel doesn't feel like doing anyway. Since the deal allows them to also reprint stuff that's still copyrighted (like Dominic Fortune) they're likely to still play ball with Marvel and Disney.

Aw man, that's awesome to know. At this rate I might be able to use the characters from those one-off horror stories in my webcomic as a cool reference, that would be crazy. I take it this happened to Strange Tales too and in a few years this will also apply to Tales Of Suspense, Tales To Astonish, and other pre-superhero Atlas titles?

Grogg is a fucking minefield, he's had half a dozen appearances in the 21st century. At the very least avoid anything more than a background joke like in a newspaper or a toy and don't refer to him by name. Silver Surfer did this with Ron and got away with it. Gargantus on the other hand might be okay? His three reappearances were in different colors but someone correct me.

For his two appearances in Strange Tales:

>Issue 80, harasses a bathysphere right after a tiger shark swims up to it, said to be 200 feet tall, bubbles come out his mouth while underwater, turns from blue to orange when in sunlight, walks in land, goes to a airport a d almost had a jet fly into his head, goes to a zoo and picks up an African elephant, trashes two howitzers upon entering a city and causing a panic, tanks two missiles, briefly turns yellow while monologuing, calls himself Gigantis (lol), passes out from the thin atmosphere
That's the shit to avoid.
>Issue 85, recap of bathysphere harassment, turning blue to orange, ship crew calls him a behemoth, two howitzers fire on him, passes out via thin atmosphere, years passed and son from first story wants to find Gargantus again after his dad died, two sailors say don't do it bro, friends tell him don't when he gets in a small sub, monster's shadow spotted, Gargantus wakes up, a panel of a dunkleosteus (?), son gets his dad's bathysphere to save the sub via spraying inky black chemical and claws (/m/ would love this guy), Gargantus attacks a big yellow boat, Gargantus remembers the kid, clearly the monster shrunk to like 50ish feet based on scale, fails to kill him on the docks so he goes for a stroll, cars pile up in awe, Gargantus calls humans mortal, rips part of the road off (back to old size), called Menacing Mammoth by narrator, interrupts a space movie with knights, soldiers with guns almost fire but don't, son challenges Gargantus to a duel under the sea and accepts, monster brags ocean pressure doesn't bother him, bathysphere electrocutes Gargantus (narrator calls him savage)
All what happened, might be good.
>Avengers Assemble, all green and no trunks, two toes instead of three, knows Hulk, red eyes, tried running away from Atlanteans led by Attuma
Also not okay.

Going to check his other appearances just to be safe.

>Monsters on The Prowl 2005, now all blue/green on land, vanished during a battle in NY, stomps on Hulk, teams up with other monsters including Grogg because he is capturrd/controlled by The Collector who Mole Man freed from his museum under Canada, Foom is completely orange to boot so that part ain't PD, confirms first two stories were in NYC, Hulk doesn't remember Groot so this took place so e time before Hulk Annual issue 5, has his shit knocked in by Hank Pym, unlike previous stories he just roars instead of talks, close up shows yellow eyes, Gargantus drools a lot here
Seems to be the modern interpretation of the character as this has its own figure.
>Thunderbolts Annual 2014, gray with reddish lips, part of a monster dungeon ran by Elsa Bloodstone to guard a necklace, Deadpool and Elektra are sent there, monsters (unlikely higher than 25 feet tall) all slaughtered, same issue has Frank Castle telling Flash Thompson to stop having sex and focus on the mission
Not okay but more of an off color cameo, maybe Gargantus had a kid I dunno
>Vengeance 2011 issue 1, Nighthawk flies by him at dusk, Kranf apparently knows Gargantus, looks tannish but hard to tell, keeps the longer tail from MotP, back fin is more consistent with Strange Tales version, just stomping through a building
Also not okay.

So reading these summaries one could use Gargantus as long as you don't:

>Go to an airport especially if he dodges a jet to the head
>Picks up an elephant
>Change him to blue, green, gray, or tan when he's destroying New York City
>Under the control of an alien or monster hunter
>Dorsal fins with consistent length
>Have him be drooling and or incomprehensive like an animal
>Be a robot (Marvel had a robot cave man of the same name in Tales of Suspense issue 40)
>Have two toes on his feet
>Red eyes or lips
>Have him guard a magical item
>Make him less than 30 feet tall
>Have him die chopped up by assassins and/or fourth wall breaking mercenaries
>Team him up with other monsters
>Call him Gigantis
>Make his tail serpentine

That everything?

Checking Grogg now. Howling Commandos version uses flame breath a d green sure, but unlike the old version he isn't orange at any point, is spelled Grog, is used as a transport like Monsteo in Pinocchio/Kingdom Hearts, aused on Merlin, nd has a a battle station on his back. Green only version in Earth's Mightiest Heroes comics under mind control by the Leader (Hulk villain), does not look like this one wears trunks. Big in Japan comics has FF communicating with him, tries luring other monsters out of Japan in a seni-heroic role. Got beat by a guy named Drop in an X-Men comic

>Russia wants to set off a bomb
>Villagers (Mongolians?) tell them that'll awake Grogg
>Do it anyway
>Fucker wakes up and wrecks a village before goes after the reds
>Nose flanes a cargo plane
>Everyone runs to a cave, Grogg goes after them, Scirntist escapes thinking Grogg is an ancient species of dragon the Great Wall was made to stop (oh get, I seen Great Wall with Matt Damon too!)
>Scientist also shoots a captor in the back

87 goes about
>Recap
>Scientist gets told by Russian farmer Grogg has been rampaging villages and shipyards
>Find Grogg in a snowy area
>Mouth flames before flying off
>Heroes steal a rocket to send him to Mars
>Scientist uses a torch to get Grogg 's attention, is briefly caught
>Sets off rocket
>Uses snowman Grogg and a flashlight to make shadow on the rocket's door, Grogg goes inside
>End

Grogg is also more consistent in size like 50 feet-ish looking at the panels.

Basically what you CAN do with him:

>Be Russian
>Awakes from weapon testing
>Main hero is a scientist that defects to America and teams up with a farmer
>Countryside rampage and destroying boats (probably not planes)
>Animal instincts and can be tricked with shadow puppets
>Send him on a rocket to Mars
>Flames out the nose AND mouth

Can't do:

>Team up with other monsters, like at all, at least not while orange colored
>Have long bat wings
>Go to Japan
>Have his species be the reason the Great Wall was built
>Shoot down a plane carrying the main hero
>Chase major characters into a cave (I guess random villagers are fair game?)
>Be mind controlled or in an alien museum
>Serve a military force featuring monsters to fight magicians puke Merlin
>Give him a backpack with guns
>Shorten the name to Grog
>Make his trunks purple

Am I missing anything or is that all?

a gov website is not going to cover your ass if these things are in fact not PD and you did not do due diligence to find out if they were

>>149245345
this is another problem, just because the content of a particular issue appears to have become PD doesn't mean it isn't copyright in another form - if it was reprinted somewhere else and that copyright is current, it doesn't matter that it was also printed in an issue that didn't get renewed

in fact, since the name would be copyright as long as some of the issues were, if the contents of many of them were either reprint or became reprint, the smart thing to do would be just not give a shit about re-registering them all - the content is covered elsewhere if that's the case

but the baseline problem with this is that JiM doesn't even become a Thor title until #83

you're all jizzing about the possibility of ripping off stories that nobody cared about when they were published, let alone today, to sell to an imaginary audience to piss off "the mouse"
