So it depends on the circumstances of his arrival and when someone got access to the Kryptonian data files.

Otherwise he'd be eligible for a O-1 or EB-1 visa, because of his "extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international acclaim"

Superman is Kiplingesque. He shows that a good upbringing from people in OUR culture is better than how he would be if a different culture raised him. That's what matters, not your parentage, but who actually acted as your mother and father. He's adopted, so he's not an alien.
Luthor on the other hand regularly violates the law, and therefore is not at the same level of citizen.
