I really liked it, it captures the feel of actual modern superman comics, not silver age comics like the Reeve movies or Alex Ross paintings like the snyder stuff.

He starts flying within 3 years. Given 3 years is on the shorter end of movie production time, you could work on it and as long as it releases after flight is inPD, it should be ok.
Similarly, you could film a Superman movie right now and as long as you don't try to make money off it until the character is in PD, and uses only the elements that are in PD when you release it, it should be fine.
