I don't think most ppl were expecting him anyway since Pascal said a live action Miles movie would only happen once Spiderman 4 and BTSV released a couple years ago. It makes sense why he wouldn't be in any of the movies as of right now. Even Peter suffers from similar rights issues where Disney can't even add him in any of the live action shows (see: Daredevil Born Again).
