Texas used to be very anal about anyone calling themself an engineer unless they were licensed but most other states were fine with using the generic term as long as you didn't try to fool the public into thinking you're a licensed engineer. Tech companies kept complaining that software engineer was an industry standard title so they should be able to use it, which caused Texas to loosen up some.
There was a weird case in Oregon a few years back where a guy commenting on something mundane about traffic lights was run through the legal process because he wrote engineer after his name. The state said that implied he was a licensed engineer when he only had an electrical engineering degree but not a license. The state lost on First Amendment grounds, probably more because they said he was prohibited from disagreeing with the way the state did traffic light timing, than about his use of 'engineer', though the court did uphold his right to use the generic term that he did.
