There's no legal opening here at all under Oklahoma state law. Force or violence is needed to constitute a battery in OK. Gently tapping someone on the chest doesn't force them to do anything and causes zero damage. Cop was just a piece of shit here and had zero justification for his extreme use of force against an elderly person.
These forceful slams of head and face into concrete should be seen on the same level as a gunshot, since they routinely and predictably cause gross bodily harm resulting in permanent injury. Painting the equivalent of diving headfirst into concrete as "an assisted takedown" like the person is being gently guided to the ground is one of the most evil uses of a euphemism I have ever seen.
Blatant corruption too that the cop had his criminal charges dropped by the AG going over the DA's head. Pulling the typical, let the cop resign and pay out the victim in a civil rights suit. In scenarios like this, it's logically incoherent that the courts can find that no reasonable officer would have found that use of force lawful, yet also find that the cop did nothing wrong. Yet this this how the criminal vs civil rights cases go.
