First of all, surveillance via ship against other ships is perfectly within the law, and has been done since the end of WW2. It is often done via less obvious methods such as submarine tho.

No it doesn't. Who would fire a torpedo at a Chinese ship in the mid east? The nations there for the most part lack any submarine capabilities, and the ones that do are going to be the obvious suspects.
