The problem is; the tax isn’t being abolished, it’s just being adjusted to $0. Sure, the immediate result is the same: that you won’t have to pay any extra money to buy a silencer, but legally there’s a distinction. The tax still exists, it’s just $0. SBR NFA status being maintained hinged on the fact that in a 1939 case, it was ruled that sawed off/short barrel shotguns are overly dangerous therefore not protected under the 2A. Later on the courts determined that since precedent says short barrel shotguns aren’t protected under the 2A, then short barrel rifles aren’t protected either because in the eyes of the court they are the same. There was a more recent SBR case where the court even acknowledged that a distinction between SBRs and SBSs could be made, but because the defendant did not try to make such an argument the court upheld that SBRs are the same as SBSs. American courts are all bullshit.

I certainly understand the frustration surrounding the 2A provisions.

I’ve been fighting for MONTHS to secure the elimination of both NFA taxation AND registration for suppressors, SBRs, SBSs, and AOWs.

I successfully added this measure for suppressors in the House-passed budget reconciliation bill, and I’ve worked with Senate Republicans to not only keep this provision but to also expand it to cover short-barreled firearms.

All of it was written into the Senate’s first version. But the unelected Senate parliamentarian struck it down, erroneously claiming it violated the Byrd Rule.

I vehemently disagree with her.

In fact, many of her rulings prove she’s a partisan hack incapable of making non-partisan decisions. To be clear, I believe the Senate parliamentarian deserves to be FIRED immediately.
