How are we feeling about this? Can it be done? Can we actually win? Can the ATF end up sucking our cocks in the end?

if there are enough new SBR and suppressor buyers, it would be hard for the courts to keep them banned under the common use doctrine. Kagan in a majority opinion and sotomayor in a dissent have both stated ARs are in common use, or at least Kagan said ARs are in common use and sotomayor said like commonly owned semi automatic rifles. if you follow the AWB/mag ban cases in NJ a dem judge conceded that AR-15s are in common use, but said that the NRA didn't prove every gun in the AWB is in common use so the AWB is still up, along with the features test, but now AR lowers that say "Colt AR-15" are unbanned.
In commiefornia the courts said mags were an accessory and the common use bruen stuff only applies to "core" second amendment rights.
So the antis already more or less conceded that if we can argue suppressors and SBRs are guns and no accessories we will get them off the NFA

Wait times average a week or so. The reason wait times were so shit originally was because applications were processed in the order they were received. Get someone in front of you that takes a month to sort out? Sucks to suck. IIRC a judge finally told the ATF to knock off the beuracratic bullshit and actually do the job of processing applications in a timely fashion, so they changed procedure to shunt delay/further investigation findings to the side and keep processing the queue as normal. That caused wait times to drop as low as 2-3 days at one point, but I think a week is pretty average now. So no, you won't be able to buy a can or sbr/sbs with a simple 4473, but effectice 1 Jan 26 you won't have to pay 200 extra bucks for one either.

they semi fixed the background check a year or 2 or 3 ago. The scam used to be they would take the registration paperwork as paper and fill them out first come first serve so if some retard felon fucked up his paperwork it would delay everyone behind him in line until his paperwork was finished even if you were literally an eagle scout ordained minister waiting behind him.
GOA or the NRA or someone sued and now you can efile and everyone who doesn't have retarded shit on their app cuts to the front of the line so wait times are in days when they used to be in months

Can we PLEASE get some legislative relief for the states with treasonous leadership?
All of this "winning" means nothing to people living behind enemy lines. WA, CA, IL, NY, NJ, CT, CO, and sorry if I'm missing any others, all have blatantly unconstitutional gun restrictions on the books - I want to see the legislators who drafted, voted in favor of, and signed into law all put in prison for treason and dereliction of their duties to uphold the constitution. I'd also like to see the governors who signed them into law tarred and feathered but a man can dream.

>Lmao
pretty much. they passed a law with a ban list and then got sued for saying anything substantially identical to the ban list was banned so they promulgated (not passed through the legislature, the AG unilaterally did this) the 1994 federal awb which is even funnier because the NJ law is from 1990 and somehow refers to the 1994 federal law.
So
>Colt AR-15 and CAR-15 Series
is listed in the ban and an AG letter from 1997 said a "Colt Match Target Rifle" was legal as it was not "substantially identical"
So as long as the roll stamp didn't literally say "Colt AR-15" or "CAR-15" it was legal as long as it passed the features test. So all the ruling did was make it legal to have AR lowers stamped "Colt AR-15"

I am guessing Trump promised something batshit crazy to make clyde grin ear to ear.

The lawsuit is all well and good until
a) the lower courts slow walk the process allowing democrats time to regain power and increase the tax astronomically
b) SCOTUS denies hearing the case
c) SCOTUS decides $0 is still a number and that Congress didn’t rule out increasing the tax later on

Nice try, but in the Obamacare "It's a mandate no it's a tax" decision, the Court as an institution could GAF. And Roberts who was the swing on that case is still there.

The Court, with exceptions like the Death Penalty swinging in the 70s, doesn't like to readdress the same issue too soon. File a case now, which the Court might not take or decide against you, and that's that for 20 years. And Trump has a shot at getting one of those Dem Justices replaced. Might get a friendlier Court if they wait.

Of course, if the GOP loses the Senate next election....

Confirmed for complete retard or a shill. How is the court going to get any better? Be specific. Thomas as said he doesn’t want to do it forever and odds are even if he retired tomorrow and Trump and a R Congress replaces him, it won’t be as good as Thomas. Sotomayor is a fat diabetic so maybe she croaks. But Kagan is only 65 and the sheboon is only 54.

You’re basically asking two different things: 1) can the government essentially say “yeah, the plaintiff is right so we aren’t going to fight it” in which case yes. In fact that’s happened fairly recently IIRC.
2) what happens if one side doesn’t show up to arguments?
In this case, SCOTUS bases their decision on the legal arguments presented in the submitted briefs, since technically speaking oral arguments aren’t required. But as far as I’m aware, this has only happened one time in SCOTUS history, with the case being 1939’s US V Miller which upheld the NFA

Ambivalent

Almost certainly not this way.
Can we actually win?
Not this case. Just because a tax is 0$ doesn't mean it's not a tax as long as it's still a valid tax system (collecting information and enforcing compliance) it should still hold up fine in courts which is pretty gay but just how it works. At best it might overturn Sonzinsky but I don't see that happening at all.

It happened at least twice in California's history in regards to Voter initiatives.
Prop 187 which barred the use of public entitlements to non-citizens in the state of California
Prop 8 which banned Gay Marriage in the state of California.
Both props overcame the cost of starting a ballot imitative, obtained the number of signatures, and were approved by the populace of the state.
Both props were then taken to court, fought up through lower federal court, then the 9th circuit and then on to SCOTUS. The state then, at SCOTUS, said, "LMAO, not gonna defend it" which then caused a default judgement against the will of the people of California by permanently enjoying the law that they passed.
Remember when Obama had the White House lit up like that fag flag? That was because of the Prop 8 decision which California refused to defend at SCOTUS.

Bruen and LBE v. Raimondo (overturned Chevron deference) have basically made the NFA toothless on everyone except FFLs who directly interact with the ATF. Without Chevron deference, all those "opinon letters" the ATF issued and backtracked on over the years carry zero weight. All that matters is what's clearly written in the black letter law. All those weird made-up regulations like "once a rifle, always a rifle," and "barrel length can only be increased by pin-and-welding, not rocksetting or simply torquing a muzzle attachment to the barrel threads" are really no longer enforceable. The ATF would have to go to court and argue completely nonsensical things like why the law says that putting a stock onto an AR pistol makes it a rifle, but taking the stock off again doesn't make it a pistol.

Not necessarily. At least one federal court quashed Obamacare based on the idea that it’s not a tax if it’s 0$. It got overturned on bullshit procedural grounds, but that logic held up.

Granted, they are almost certainly going to be retarded in another way. I haven’t read the lawsuit, but I bet GOA is going to be their typical retarded maximalist selves and push for the entire NFA to be invalidated, machine guns and all. And there is approximately zero percent chance the judges overturn the MG and DD parts.

They ought to just focus on the achievable goals of removing suppressors, SBR/SBS and AOWs

https://www.gunowners.org/wp-content/uploads/GOA-One-Big-Beautiful-Lawsuit.pdf

On July 4, 2025, President Donald J. Trump signed into law the One Big Beautiful
Bill Act, H.R. 1, 119th Cong. (2025).
39. The Act eliminated the transfer and manufacture tax on all NFA firearms except
machineguns and destructive devices. Id. § 70436. The transfer and manufacture tax on
machineguns and destructive devices remains at $200. But the transfer and manufacture tax is now
set to zero dollars for silencers, short-barreled rifles, short-barreled shotguns, and the NFA’s “any
other weapons” category.
40. ATF nevertheless continues to enforce the transfer and registration requirements
established in the NFA against Plaintiffs and other similarly situated parties.

The government considers it a tax still and when you file it they consider it paid (you got taxed and it's retarded but it is how the government works). It is most likely going to be entirely based on if congress has authority over tax and commerce powers (which it does). The law still has a structure and function (to regulate cross state transfers and if in the future they want to add a tax back onto it) so it still performs a function (a gay function)

The best thing you can do (rather than giving GOA or NRA money) is once the fee is 0$ is to get as many people you can to get NFA items and make them as common and widely used as possible. The more people have them the more people have vested interest in deregulating them.

They’ll be perfectly fine. The last 2ish years with shortened wait times have been the best sales ever for suppressor manufacturers. Any Tom, Dick, or Harry with a machine shop can easily spin up production for simple .22 cans. Any retailer selling suppressors sells other shit and again, have had tremendous suppressor sales recently.

My LGS is letting people buy them now and they’ll hold them until Jan 1 to skip the $200. I’m sure tons of places will do the same.

Answer this. It’s really simple.

You said
>Might get a friendlier Court if they wait.
You directly said the court will be better in the future and they should wait to file lawsuits. Why?

I have further evidence you’re retarded because you’re also arguing that barrels aren’t necessary for guns to function. You are gave up the “you have to have a magazine to function argument” so when will you drop the barrel length argument?

Type 1 Diabetic since 11 here, I'm now 32. The truth of the US insurance industry is that it's a great piggy bank for fincap to use. It is also semi regulated which means it has a lot of the elements of all the worst things. That being said, the primary reason US health care is a shit storm is cultural. We have not had constant expected doctor access for any point in our history. It is in living memory that quite a few boomers actually saw their first doctor in their 20s-30s. The US system in particular also deals with a ton of fund raising issues for medical facilities as they are not really profitable (that is not the purpose of a hospital and you can't make it the purpose without making th care worse). So you get a lot of half measures that are dependent on our spending ability (highest in the planet) to help make these institutions any form of solvent. The insurance industry has latched onto this and made themselves a massive sore as a result. There are a number of legislations seeking to address this, the ACA in particular was full of many many clever clauses that helped protect the chronically I'll while encouraging front loaded use of health care (cheaper to prevent issues than fix). But while I love my people, this is the exact policy we are the worst at. The US can and has made long term investments but we live in a generation that never made the initial purchase and has been riding big payouts from previous public works, so healthcare as a result is woefully under equipped to actually improve. That being said the biggest perk of our healthcare system is a massive pharma tech industry that in my lifetime may cure my illness permanently, and in the meantime has upped the tech for my care more than any other country on the planet (yes I know insulin was made in Canada but all of the US market driven research into CGMs and viral treatments have been driven via profit motive research.

Niggers and notrainings do that. You don't see cops doing that in police shooting videos but often the ones shooting at them do.

I had to go through an academy where I was literally tortured. Hooked up to a car battery, drowned, and attacked by attack dogs. I wish I were joking. I feel like those parts were unnecessary but at least they put you through a course of fire and you have to maintain firearm certs 4x a year.

convince everyone you know (within reason) to get a nfa item. The more people that interact with it the better. For 90%+ of the voter base the nfa doesn't exist and is meaningless to them. Forming a new party for stuff no one cares about won't do anything. Focus on your local election and politics, hijack the local gop and reforge it to believe what you do. For federal election probably just vote GOP until it changes from the local up.

No more nation wide injunctions. Looks like you have to join GOA and give them money to get relief from the NFA registration requirements.

Let’s say the court rules in our favor does that mean the registration portion of the law gets struck from the U.S. code? If not then the dems have an opportunity to back door the tax again later. Nullify and remove are 2 different things.

Things aren’t as rosy as you make it seem. Again, this is the gayest timeline.

that's verifiably not true, after the dems added the awb provision to the bill reagan had to personally call multiple republicans to get them to defect to get the crime bill to pass. it only passed 235-195 in the house and 61-38 in the senate
https://clerk.house.gov/evs/1994/roll416.xml
in the house 46 republicans voted for it 146 voted against and 1 didn't vote
https://www.senate.gov/legislative/LIS/roll_call_votes/vote1032/vote_103_2_00295.htm?congress=103&session=2&vote=00295
in the senate 6 republicans voted for it, 36 voted against and 1 didn't vote.
adding the amendment in the first place was 56-43-1https://www.senate.gov/legislative/LIS/roll_call_votes/vote1031/vote_103_1_00375.htm

Holy fucking shit you two are obvious disinformatuon agents. Do better, shareblue faggots.

Yes republicucks are not our allies, but that doesnt make Dems a viable option. Dems are a no-go because their entire party is a hive mind kept in-line with the threat of losing power and position at the slightest hint of deviation from the party line.
Republicans are not our allies but they are a far cry from the omnious, cancerous echo chamber of self loathing that is the democratic uniparty.
Republicans can never stay united long enough to fight the good fight cause its so many causes from so many viewpoints whereas the democrats cry out in one voice "we are the party of empathy! Be like us, or be lost to history." Those niggas are the fucking borg man and so even if they ran on the free blowjobs and healthcare for everyone ticket id vehemently resist their efforts tooth and nail.
The republicans, however...well, a divided house is safe for liberty.
So yeah go shill your "id vote democrat if they spoke for me" shit somewhere else cause the party that wallows in the blood of innocents to push their 70 year old agenda speaks in the voice of Legion.

There are fewer than 15 mass shootings per year, usually 12 or fewer. that 300 or 1,000 or whatever number is literally just black gang members engaging in mutual combat.
also that 300 number counts any injury. there was one where some gang member intentionally or accidently shot some guy's car while people were in it and 3 people went to the hospital with minor scratches from auto glass and that was counted as a "mass shooting"
