Fifth, It's been concretely established and has been the accepted ROE since WW2 that the Geneva convention is a state-state treaty, which does not directly bind soldiers (who are bound to their respective forces) and does not apply to non-state combatants, non state entities who themselves breach the geneva convention, or common criminals. There are strings. To be protected by the convention, you must yourself abide by it.
