I want to get my first handgun. Had an MMJ card over a year ago. Talked with plenty of people that said they purchased guns when they had one. I just don't want to take the chance of getting denied and wanted to know what /k/ had to say.

What state are you in, and how much do your local police give a shit? You theoretically shouldn't have any hang ups on a background check so it's dependent on them.

You're commiting felony perjury by lying about being an unlawful user of a controlled substance under federal law. Your medical information is private and requires some pretty heavy evidence for a judge to order a warrant for surrender of it however, and if you're in a state with medical the local PD isn't going to bother dealing with individuals and the DEA is going to be too busy going after the cartels that inevitably setup shop to take advantage of the system to care. You should be fine, assuming the administration doesn't reverse course, instruct the DEA and DOJ to crack down on state level weed, and put pressure on the judiciary to enforce federal law and get those records turned over to the FBI for integration into the NICS and review of all 4473s. Then there's still the issue of it being medically prescribed, at which point if you let the prescription last for a year you're (I am not a lawer and am probably wrong) considered "no longer using". However they'd probably charge everyone who was caught in that kind of dragnet with felony perjury which means you'd lose your rights at some hypothetical unknown future date.

From what I can tell you're SOL, supposedly they will deny you a PA permit if you have a medical marijuana card. If other people managed to get guns while also having weed, you should probably ask them when and how that happened because I wouldn't be so sure it's as simple as just not disclosing that.

Like I said they commited felony perjury which, if convicted of (and it would not be a hard conviction with the record correlation) would result in permanent loss of many rights barring a federal pardon. The odds of it are nonzero but likely extremely small. Just don't smell like pot, keep your mouth shut about it, check NO in the relevant box (21.f).

I think the best way to find out is to try. Go to the gunsore and ask to buy the cheapest POS single action heritage revolver they have in the case and see if the nics goes through. Then order w/e you actually want off the Internet if you know you pass it.
