In France too it is illegal to carry any weapon for defense, including pepper sprays and shockers. You can get up to one year because you need a permit that is not issued since decades to civilians for these.

Despite that, these two are tolerated by the police if you are not caught committing a felony while carrying it. The police while likely confiscate it and that's all, or if they feel that you was about to abuse it, they can fine you as a first warning.
If you defend yourself with it, lawyers have a jurisprudence that usually force the judges to throw any charge of carrying without a permit as the state basically failed to prevent the attack you were victim of.

So there theory and there the field. Are you sure that Netherlands is enforcing these laws for pepper sprays, or just keeping it as an option to indict troublemakers? Despite, I understand that depending on how the cop is feeling about it is very unpleasant since there still a possibility of being indicted.
