Genuinely what could they possibly get her for if she never said she was a woman? Couldn't she literally just say "I'm just a very gender non-conforming man, why would he think I'm a woman?" And whenever they bring up aspects of social transition go "No, I don't think wearing makeup makes me a woman, not my fault that he's assuming that."

This is a fine idea until you pull up her social media or dating profile or whatever where she explicitly IDs as female. Guarantee you that a competent prosecutor could find at least one instance.

The better question is: what crime is this? Is it rape / sexual assault? Usually deception alone isn’t adequate to give rise to that. You can lie about being a billionaire, have sex with a would-be gold digger, and it’s not a crime. Likewise, you can lie about your age, whether you have any intention of pursuing a serious relationship, and a million other things. Did we make up a new definition or category just for this?

Rape by deception includes things like lying about wearing a condom, impersonating the other person's partner or claiming a sexual act is part of a medical/therapeutic procedure. Lying about wealth, social status, job, religion, marital status, or intentions for a relationship does not count.

Also I don’t believe that trans people should have to disclose, but if the partner is likely to find out during then you probably should as to not be hate crimed. If the sex doesn’t involve the trans persons genitals then why does it even matter? That’s on the other person for who they find attractive.
Also also “biological gender” is gobbledygook and a dog whistle. My biological gender is female, my biological sex is trans female, and my natal sex is male. People say “biological” these days without understanding biology just to demean trans people
