BMW can call that any way their marketing wants. There are several versions of xDrive, but most don't use center differential and have a clutch pack instead. These things are different. Just find a real engineer and ask him what a mechanical differential is if you don't believe me, or wikipedia, or probably any technical document.
There are other examples besides BMWs. Most AWD cars made by VAG don't have a center diff either, but some even have "4x4" badge on their trunk lid. Most if not all Hondas too. I bet it's easier to enumerate cars that have center diffs than those that don't.
