I mean, yeah. The entire point of road design after the advent of cars has been to minimize congestion and travel time, which is most effectively done by giving fast drivers the ability to pass slow drivers whenever they want with as little associated risks as possible.
65 percent of traffic jams are caused by left lane hoggers and idiots who break down in the middle of the road. Pretty much every state has enacted left lane hogging penalties in the past decade or two, but since police can't just turn on their radar gun and jerk off like they do for speeding it's not nearly as well-enforced as it should be.

If a car is on the left lane already, there's no such issue, the main complain of this thread to begin with is that someone is hogging the left lane.

When people are saying overtake from the right, they don't mean merge all the way to the exit lane, the mean pass him on HIS right. Most highways are 3 lanes already, so in reality you're merging from the middle lane. What if the highway is two lanes only? well, your little made-up scenario doesn't apply to a two lane highway either. So if the danger is that the driver being passed has to split his attention between two vehicles, I assure you, that's not something that happens unless you're in the middle lane. AKA: not what we're talking about.
