They could not be classified as domiciled. That is to say, while Wong did not make any meaningful reference to lawful domicile in its reasoning, it impliedly excluded illegals because they could not be domiciled; they were treated explicitly as criminals and would be hung; or
Slightly differently, that while they may have been classed as domiciled (in the way that a criminal may still be domiciled in a state), the status of illegals at the time means that Wong simply did not address them as a class (and indeed, at no point is immigration status in as far as immigration law is concerned really touched upon), so Wong may be a precedent on domiciled legal residents, it has made no mention of illegals so shouldn’t be considered an authority there.
There’s probably something in their referencing back to historic English common law where many of the principles would have pre-dated formalised immigration laws, but I’m too tired to really look through all the references there now.
In short, I think arguing that Wong explicitly applies only to children of ‘lawful permanent residents’ is wrong (it’s too easy to dispute because Wong doesn’t, on its face, say that). Better to argue that Wong either impliedly excludes illegals or simply does not touch upon illegals at all; that ‘domiciled’ in the context of the case meant only lawful residents.

Lawyer here. This is what will happen: due to conservative balance on the supreme court, birthright citizenship is basically dead in the next six months. This issue will be litigated in the supreme court and it's gone. That being said, there is a 0% chance that it becomes retroactive. That would cause 50+ mil citizens to lose citizenship overnight. The majority of those people are working age and this will literally cause the American economy to collapse. Schizo retards on 4chan can pray that it will be retroactive but it will never happen.
