That's where SCOTUS comes in again in October of 2025 where they will make a ruling on the merits of the case.

SCOTUS will rule on the 14th amendment and if POTUS's Executive Order is ruled constitutional by SCOTUS then that is RETROACTIVE.

Meaning it will be RETROACTIVE going back to 1866 and if not 1866 then 1929 because that is when the Permanent Residency Card system was created, meaning the children of illegals going back to AT LEAST 1929 are now no longer US Citizens.

The EO doesn't phrase it that way but if SCOTUS makes a ruling on the 14th Amendment which is a constitutional question then THAT would be retroactive all the way back to when the 14th Amendment was ratified which is like 1866 or some shit.


Trumps EO states:

“Sec. 2. Policy. (a) it is the policy of the United States” to no longer ISSUE or ACCEPT documentation of citizenship in two scenarios: “(1) when [a] person’s mother was unlawfully present in the United States and the person’s father was not a United States citizen or lawful permanent resident at the time of said person’s birth, or (2) when [a] person’s mother’s presence in the United States was lawful but temporary, and the person’s father was not a United States citizen or lawful permanent resident at the time of said person’s birth.”

it goes on to say...

>(b) Subsection (a) of this section shall apply only to persons who are born within the United States after 30 days from the date of this order.

The date of the order was January 20th, 2025.
So that means it only went into effect on February 20th, 2025.
