The precedence was set by a case called RvPham, My country is a joke. Our constitution was written in the 80s and it enshrines anti-whiteness. Section 15 subsection 2 says that the government is allowed to discriminate against majority groups if it helps minority groups. Our courts have ruled that because there are laws that criminal immigrants should be deported, and that that means that a non-immigrant would get a lesser sentence for the same crime as they would not be deported on top of the existing punishment, that the courts are constitutionally required to give immigrants lesser sentences to comply with section 15 sub section 2. It's fucking insane.
