Not if it was an accident. I didn't see him, I'm so sorry. I was looking over my shoulder to change lanes. There have been plenty of cases where pedestrians get wiped out while jaywalking because the expect traffic to slow down or stop for them. Those drivers aren't prosecuted. If you're a pedestrian in a roadway you're the one in the wrong and everyone has right of way over you. The only time pedestrians have right of way is in a crosswalk. If you hit someone in a crosswalk then you can expect trouble.
