Section U.S.C 230(c) -- You are not responsible for what users post on your website. The feds have to go after the person who posted it. This immunity is what lets facebook and co exist.

In that case you look into your software stack, specifically how you handle image upload. I don't fuck with AI stuff too much but you probably want to write logic that looks like this:

-> Catch File
-> Validate MIME
-> Send to AI for characterization (you want a local model, something cheap and inexpensive ideally. Maybe there is a deepseek or qwen model suited?
-> If pass, render image to thumbnail
-> If fail, reject post

In the Netherlands you are obligated to remove unequivocally unlawful content.
For other content (the legal grey area) it can stay online until the police, a criminal court or a civil court asks for it to be taken down.

In some respects Dutch websites take less things down than American websites (if something isn't allowed on YouTube you can just go to video sites here, as deplatforming and prudishness aren't much of a thing). And in some respects they take more things down (hate speech is a crime. But then again, people take less offense to things like the nigger word so the values are just different).

I've not exhaustively tested this, but I tried a local LLM (on my computer) to test image classification, and I was not impressed with the results. Like all LLM the result is suggestive, and often right. But also often wrong.
That might be okay for tagging or writing image descriptions for personal use, but it's not suitable for moderating a large scale forum where your ass is on the line.
That's probably one reason why serious players use a cloud service because they can have larger and more capable models.
However, this may change as local LLM improve, or if someone releases a finely tuned CP detection LLM.

I'll also add there's some confusion about the technology on offer. First there are image hashes, which just computer the image hash and compare it to a list of known files. The problem with this is that images can be cropped or slightly altered to pass through the hash filter.
So MS created PhotoDNA, which uses some math to detect altered images. But these only work for known images, not new images.
So AI is the next step, because it can classify an image as

The only remaining problem is reliability.
