If they could prove it, they definitely would. It is much harder to do it against a sitting president. They would wait until he is out of office. To do it to a sitting president, he would first have to be impeached by an act of congress. See Richard Nixon and watergate.
That being said, after trump’s first presidency, he was already taken to court on a vast array of charges, some of which stuck, some of which did not because of immunity.
