Key Provisions of AB 495 (Family Preparedness Act of 2025)
• Streamlined Temporary Guardianship
The bill creates a new process in probate court for short-term guardianships, enabling temporary care arrangements without extinguishing parents’ rights. Parents could designate trusted individuals to step in legally when needed.
• Expanded Definition of Eligible Caregivers
It broadens the pool of who can be appointed via an authorization affidavit, extending it beyond relatives to include “non-relative extended family members.”
• Limits on School/Childcare Enforcement Collaboration
AB 495 proposes to restrict how much schools, daycares, and similar institutions can cooperate with immigration enforcement, thereby protecting the continuity of care and education for children.
• Legislative Traction and Debate
The bill has already passed the Assembly and is slated for consideration in the Senate Appropriations Committee later this month.
